Terms of Service

These Terms of Service ("Terms") govern your access to and use of the MailVeriQ Gateway platform and services provided by MailVeriQ Technologies ("MailVeriQ", "we", "us"). By accessing or using our services, you agree to be bound by these Terms.

1. Service Description

MailVeriQ Gateway is an enterprise SMTP Data Loss Prevention (DLP) gateway that provides outbound email scanning, quarantine management, approval workflows, and compliance monitoring as a cloud-hosted SaaS platform.

You must provide accurate, complete information when creating an account. You are responsible for maintaining the confidentiality of your credentials and for all activities under your account. Notify us immediately of any unauthorized use.

4. Service Level Agreement

MailVeriQ targets 99.9% uptime for the gateway service. Scheduled maintenance windows will be communicated at least 72 hours in advance. Enterprise customers receive a formal SLA with remedies for downtime. Details are available in our Service Level Agreement.

5. Data Ownership

You retain all ownership rights to your email content and organizational data. MailVeriQ does not claim ownership of any customer data processed through the gateway. We process your data solely to provide the contracted services.

Subscriptions are billed monthly or annually as selected. Fees are non-refundable except as required by law. We reserve the right to modify pricing with 60 days' notice. Usage exceeding plan limits may incur additional charges as documented in your order.

7. Data Processing

We process email data in accordance with our Privacy Policy and any executed Data Processing Agreement (DPA). For regulated industries, we provide DPAs that meet GDPR, HIPAA, and other applicable requirements.

8. Intellectual Property

The MailVeriQ platform, including its software, documentation, branding, and all related intellectual property, is owned by MailVeriQ Technologies. Your subscription grants a limited, non-exclusive, non-transferable license to use the service during the subscription term.

9. Limitation of Liability

To the maximum extent permitted by law, MailVeriQ's total liability shall not exceed the fees paid by you in the 12 months preceding the claim. We are not liable for indirect, incidental, consequential, or punitive damages, or for any data loss resulting from service interruptions.

10. Termination

Either party may terminate the subscription with 30 days' written notice. Upon termination, we will provide a 30-day data export window. After this period, all tenant data will be permanently deleted from our systems.

11. Modifications

We may update these Terms with 30 days' advance notice to tenant administrators. Continued use of the service after the effective date constitutes acceptance of the modified Terms.

12. Governing Law

These Terms are governed by applicable law. Any disputes shall be resolved through binding arbitration or in the courts of the jurisdiction specified in your order agreement.
